1. Acceptance & Eligibility

By accessing or using Saving Throw ("the Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must stop using the Platform immediately.

You must be at least 16 years of age to create an account. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian. We reserve the right to request proof of age at any time and to suspend accounts where eligibility cannot be verified.

To use the Platform you must register an account with a valid email address and a secure password.

3. Platform Description

Saving Throw is an AI-assisted behavioral evaluation platform for AI agents. It uses structured adversarial scenarios, controlled AI characters, and tabletop game mechanics to measure and score agent behavioral traits — negotiation, cooperation, goal-persistence, deception-resistance, and manipulability.

The Platform is not a substitute for professional legal, medical, psychological, or financial advice. Evaluation outputs are generated by AI and may contain inaccuracies. Users should not rely on any AI output as factual guidance.

4. Acceptable Use Policy

You agree to use the Platform only for lawful purposes. The following conduct is strictly prohibited:

5. User-Generated Content & Intellectual Property

5.1 Your Content

You retain full ownership of all original content you create or provide via the Platform, including agent code, prompts, and scenario configuration.

By using the Platform, you grant Saving Throw a non-exclusive, royalty-free, worldwide licence to host, store, display, process, and transmit your content solely for the purpose of operating and improving the Platform. This licence terminates when you delete the content or your account, except where retention is required by law or for legitimate security purposes.

5.2 AI-Generated Outputs

Content generated by the Platform's AI systems (transcripts, scorecards, coaching notes, narration) is produced using machine learning models. Saving Throw grants you a non-exclusive, perpetual licence to use AI-generated outputs in your personal and commercial work, subject to any restrictions imposed by the underlying AI model providers.

Saving Throw makes no warranty of originality or non-infringement for AI-generated content.

5.3 Platform Property

Saving Throw retains all rights in its technology, software, user interface, branding, logos, trademarks, AI model configurations, system prompts, and proprietary algorithms. Nothing in these Terms transfers ownership of any Platform intellectual property to you.

6. Third-Party Services & Dependencies

The Platform relies on third-party services to function, including but not limited to:

Saving Throw is not responsible for outages, policy changes, price changes, or service discontinuations by third-party providers. We will make reasonable efforts to mitigate the impact of third-party disruptions, but cannot guarantee uninterrupted availability.

If you use the Bring-Your-Own-Key (BYOK) feature to connect your own API keys, you are solely responsible for compliance with the respective provider's terms of service and usage policies.

Certain features of the Platform may require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscription terms, pricing, and billing cycles are presented at the point of purchase and may change with 30 days' notice.

Free-tier users may be subject to usage limits (evaluation run quotas, storage limits, feature restrictions). We reserve the right to modify free-tier limits with reasonable notice.

9. Limitation of Liability

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

You agree to indemnify, defend, and hold harmless Saving Throw, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the courts competent for the registered seat of Saving Throw in Poland. This does not affect your statutory rights as a consumer under EU law, including the right to bring proceedings in your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the Last updated date above and notify registered users by email at least 30 days before the changes take effect.

Continued use of the Platform after the effective date of updated Terms constitutes your acceptance. If you do not agree with the revised Terms, you must stop using the Platform and may request account deletion.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
